Terms and Condition of Sale

Prices: Net F.O.B. Cumming, GA. All prices are subject to change without notice. Web site pricing valid as of day order is placed.

Payment: All sales prepaid or COD. Cash, money order, cashier or certified check, and bank cards are acceptable forms of payment. Personal and company checks accepted only after the check has cleared and funds are deposited in our account. Note: This may cause delay in shipping. On all COD shipments, customer pays COD fee if demanded by the carrier. (COD orders available for wholesale accounts only.). Deposit may be required on custom or special order items.

Shipping: Orders for in-stock items ship within 1-2 business days. Orders are not charged until date of shipping with the exception of special-order items. All orders are shipped via UPS. We can not and do not ship via US Postal Service except for overseas orders when UPS is not available or cost is prohibitive. Only when specific instructions are given and confirmed will the shipping method be altered. Orders received before 3:00pm EST for a product that is in stock are usually shipped the same day. For orders placed on our web site, shipping charges are approximate. The actual shipping charges will appear on the e-mail confirmation and on the invoice you receive with your order.

All orders that are shipped within the United States via UPS are shipped Signature Required.  To opt out of this requirement, once your order is shipped, please visit myups.com and follow the steps to remove that feature from your shipment.
Returns: We will not accept unauthorized returns. Please contact us whenever there is a need for adjustment. Return or replacement requests by phone contact only - please note this is done for your safety and protection of billing information - e-mail requests will not be acknowledged. Returned parts must be in clean, unused, original condition, packed in the manufacturer's original packaging, and received at NLA Parts within 30 days of date of sale. We will not accept returns after 31 Days. No return will be accepted without invoice/sales receipt number or date of sale. No return on used parts, consumable items (brake pads, clutches, fluids) even if unused. We will issue you a return authorization number that must be marked on the return package. Our shipping & receiving department does not accept packages without return authorization number. Returned items will be inspected before a refund is issued. No COD refunds accepted. There are no returns on custom or special order parts. There are no refunds on electrical parts unless part is deemed defective by NLA Parts. There are no returns or refunds on software products (covered by their own manufacturer warranty and technical support).  NO RETURNS ON USED OR CLEARANCE PARTS. Refund is given only after returned parts are received and inspected by NLA Parts.
At NLA's discretion, a 15% restocking fee may be charged/deducted on all returns, regardless of whether the item was ordered in error by telephone or on NLA Parts web site. Refused deliveries may also be subject to the restocking fee.

Claims: When packages appear damaged on arrival, state condition of the container over your signature on the receipt. If damage is discovered after opening the container, notify the carrier immediately. We provide good merchandise, properly packaged to the carrier. Claims for damage must be directed to the carrier FIRST, not to NLA Parts.

Ordering: All orders must be placed online or over the phone.  No orders or order changes will be accepted via email or other means of contact.
Limited Warranty on New Parts: All new parts are guaranteed to be first quality merchandise. Defective merchandise must be returned at customer's expense for replacement. We will replace all defective parts which were purchased new, but cannot accept responsibility for inconvenience or losses occasioned by their use. There is no warranty if parts have become defective due to faulty installation or if they have been abused in any way. Parts must be installed by a certified technician. "Do it Yourself" installations are at your own risk. All warranties and/or guarantees are voided if products have not been installed properly by a qualified licensed auto mechanic experienced in the installation of the product(s) who have followed standard MINI and NLA Parts installation guides. There is no warranty, expressed or implied for any parts (including new parts) or work used for competition, or track driving school events. There is no warranty on electrical parts except as supplied by the manufacturer. Certain products we sell do carry a manufacturer's warranty. All new parts, with the exception of electrical parts, high performance products and products already carrying a manufacturer's warranty will be warranted against manufacturing defects only for 12 months from the date of sale or "limited lifetime" depending on the specific product (see product details). Customer shall notify NLA Parts within 10 days of discovery of any such defects. We reserve the right to withhold refund until the defective part has been examined and tested. NLA is not responsible for shipping costs on items returned under this limited warranty. NLA Parts is not responsible for labor charges due to incorrect installation or faulty or defective parts. Please inspect items carefully before installation!

Used Parts: There is NO WARRANTY on used parts. All used parts are sold "AS IS" and come with no warranty unless otherwise stated. Used parts are not returnable.
Limitation of Liability and Indemnity: Customer assumes all liability and risk arising from the ordering, purchase, use or installation of new and used parts that are purchased from NLA Parts. NLA Parts shall not be liable for any damages to any person or property arising out of or in connection with the use or installation of any parts that it sells or installs including, but not limited to, high performance products, engine chips, springs, sway bars, or exhausts. Customer agrees to indemnify NLA Parts from any and all claims (including legal fees) arising out of or in connection with the use or installation of the product(s) it purchased from NLA Parts or had installed by NLA Parts authorized dealers/installers. NLA is not responsible for any damages or claims arising out of a delay in the processing or shipment of any order. By purchasing products from NLA Parts or by paying NLA Parts to install any products, Customer is acknowledging that it agrees to accept this Limitation of Liability and these Terms and Conditions.

Product Use: Many items are sold for competition and off road use only. It becomes the sole responsibility of the Customer to ensure that the use of their vehicle and items purchased comply with federal, state, and local regulations. NLA Parts products are not certified legal for sale or use in the state of California on any pollution-controlled motor vehicles. Performance products are legal in California only for racing vehicles, which may never be used on a public highway.

Merchandise: We sell new and used parts for MINI Coopers and other automobiles. Please note that product descriptions and photographs used on our online catalog are examples only. Actual item may differ in appearance to minor degree.

Fraudulent Orders: We will seek to prosecute any and all fraudulent transactions. We use all means necessary to convict including recording of IP addresses. All fraudulent orders will be filed with the IFCC (Internet Fraud Complaint Center). The Internet Fraud Complaint Center (IFCC) is a partnership between the Federal Bureau of Investigation (FBI) and the National White Collar Crime Center (NW3C). http://www1.ifccfbi.gov

Applicability: These Terms and Conditions are applicable to all orders placed by the customer, whether online on NLA's web site or by telephone, including all future orders.
